Powell published an emailed statement from Strategic Communications Director of the City of El Paso, Laura Cruz-Acosta:

“The appeal was dismissed because there is no longer a dispute over the validity of the (Texas Historical Commission) permit since the property at Santa Fe and Overland is no longer the location of the (Multi-Purpose Arts and Entertainment Center) MPC.”
