On December 22, 2021, following a ruling by the 8th Court of El Appeals in El Paso, the City of El Paso filed a petition for review with the Supreme Court of Texas. You can view the case history here.
Yesterday the Supreme Court did not grant the City’s petition but instead ordered full briefing on the merits from the litigating parties.
The order explicitly states: “The petition for review remains under consideration by the Court.”
